CONDITIONS OF MEMBERSHIP AND TENANCY

SUBSCRIPTION

The annual subscription and rent shall be paid by the 1st of April annually. This shall be agreed annually by the management committee.

If a plot holder’s subscription and rent remains unpaid for a period of 2 months the membership and the entitlement to the plot shall be deemed to be terminated and the plot may be re-let.

LETTING

The letting of plots shall be undertaken by the association.

Vacant plots shall be filled using the official Fife Council waiting list for that site. A copy of all site lists and waiting lists will be maintained by Community Services, Parks and Countryside for public record.

Existing plot holders who wish to change plots should put their name on the site waiting list. Any such changes will be at the discretion of the committee and as a plot becomes vacant priority will be given to internal changes before a plot is let to a new tenant.

It is not permitted for plot holders to pass on the tenancy in part or in whole, to any other party by private agreement. In event of this being established the tenancy will be terminated and the plot let following the agreed procedure. The tenant must advice the management committee if they wish to terminate their tenancy and thereafter re-letting will be carried out in accordance with the procedure outlined above.

If any tenant is unable to service their plot through illness, temporary disability or temporary absence then it is permitted to allow a third party to service it for a period of 12 months.  This third party may be the Community Garden Group by arrangement.  Such arrangement must be made in partnership with the committee. If after 12 months the situation persists then the management committee have the right to terminate the tenancy. When the tenancy is terminated the plot will be re-let in accordance with the letting process.

SECURITY

Each plot holder will have a key to the shed and site. This is available from the committee on payment of the appropriate deposit. On termination of their tenancy the key will be returned and the deposit returned.

ACCESS

No vehicle, trailers or materials should be parked or left, on a permanent basis, on the main entrance area, paths and car park.

APPLICATIONS

Anyone wish to apply for a tenancy of a plot should fill out an application form. These forms are available from the committee or Fife Council. Having filled out a form the applicant’s name shall be put on a waiting list. Only those who are on the waiting list will be offered the tenancy for the vacant plots.

No person will be permitted to register on the waiting list of more than two sites at anyone time. Where a person already holds the tenancy to a plot they will not be permitted to hold a further plot unless there is no existing demand at that location.

SERVICING OF PLOTS

The function of the plot is for the production of garden produce including flowers, vegetables and fruit.

Tenants are expected to maintain their plots to an acceptable standard in regards to good organic horticultural practice and to maintain an acceptable level of cultivation. Where it is considered that a plot is being neglected a plot holder will be duly advised (verbal or written warning) and will be expected to improve the quality of maintenance. If there is no improvement after 3 months the committee may issue a second warning.  In the event that a plot remains in a neglected state throughout a complete growing season and the plot holder has received 2 warnings the management committee have the right to terminate the tenancy. Fife council will assist with tenancy terminations and will keep the waiting list for the site.
